Gno.land, hosted by NewTendermint, LLC (“NewTendermint”, “we”, “us,” or “our”), provides Gno.land which is the next generation of smart contract platforms. Gno.land is the central repository of the ecosystem, with realms built using fully transparent, auditable code that anyone can inspect and reuse.

1. Scope and Updates to this Privacy Policy

This Privacy Policy applies to personal information processed by us in connection with Gno.land, or wherever this Privacy Policy is linked. By accessing or using Gno.land, you signify that you have read, understood, and agree to the Gno.land Terms and Conditions and to our collection, storage, use, and disclosure of your personal information as described in this Privacy Policy. You also acknowledge that once your personal information has been entered, you may no longer be able to access, delete, or modify the personal information you have provided.

Changes to our Privacy Policy. We may revise this Privacy Policy from time to time at our sole discretion. If there are material changes to this Privacy Policy, we will notify you as required by applicable law. You understand and agree that you will be deemed to have accepted the updated Privacy Policy if you continue to use Gno.land after the new Privacy Policy takes effect.

2. Personal Information We Collect

We collect personal information mainly to provide you with the services on Gno.land. The categories of personal information we collect depend on how you interact with us and the requirements of applicable law. We collect personal information from a variety of sources, such as when you provide it to us (such as online or in-person through events such as conferences), information we obtain automatically when you use Gno.land, and information from other sources, such as third-party services and organizations as described below.

  • Identifiers. We may collect identifiers such as your first and last name, email address, github address, username, profile picture, phone number, or address when you register to use Gno.land.

  • Geolocation. We may collect your location information, such as where you live or use Gno.land.

  • Your communications with us. We may collect any personal information that you provide in your communications with us.

  • Personal information collected automatically. We may collect certain information automatically when you use Gno.land, such as your Internet Protocol (IP) address, github address, user settings, cookie identifiers, mobile carrier, mobile advertising and other unique identifiers, browser or device information, and Internet service provider. We may also automatically collect information regarding your use of Gno.land, such as pages that you visit before, during, and after using Gno.land, information about the links you click, the types of content you interact with, the frequency and duration of your activities, and other information about how you use Gno.land.

You may be able to stop or restrict the placement of certain tracking technologies on your device or remove them by adjusting your browser or device settings. However, please note that by refusing or clearing our functional cookies - which are used to verify actual users to distribute tokens - will impact your ability to use Gno.land. Certain online advertising industry websites may allow you to opt out of receiving targeted ads from data partners and other advertising partners that participate in self-regulatory programs by visiting the Network Advertising Initiative and the Digital Advertising Alliance. Please note you must separately opt out in each browser and on each device.

3. How We Use your Personal Information

We mainly use your personal information to provide you with access to our services, answer requests for customer or technical support, communicate with you about your account, activities on Gno.land, and policy changes, and register for other NewTendermint offerings. We may also use your personal information for a variety of business purposes, including to provide you with Gno.land, for administrative purposes, to collect analytics, for our security and fraud prevention purposes, and to market Gno.land. We might also use your personal information for direct marketing, research and development (including marketing research), network and information security, and fraud prevention. Your personal information may also be used to measure interest and engagement in Gno.land, improve, upgrade, or enhance Gno.land, develop new products or services, debug, identify or repair errors, enforce or agreements, and policies, and any other activities required to comply with our legal obligations.

We may also use your personal information for other purposes that are clearly disclosed to you at the time you provide your personal information or with your consent.

4. How We Disclose your Personal Information

We disclose your personal information in the following ways:

  • Service Providers. We may disclose your personal information with our third-party services providers and vendors that assist us. These third-parties may include IT support, hosting, customer service, and related services.

  • Business Partners. We may disclose your personal information with our business partners, including those with whom we jointly offer products or services.

  • Affiliates. We may disclose your personal information with our company affiliates, such as for our administrative purposes, IT management, or for them to provide services to you or support and supplement Gno.land.

  • Advertising Partners. We may disclose your personal information with third-party advertising partners. These third-party advertising partners may set tracking technologies to collect information regarding your activities and your device (e.g., your IP address, cookie identifiers, page(s) visited, location, time of day). Both we and these advertising partners may use this information (and similar information collected from other services) for purposes of delivering personalized advertisements to you when you visit digital properties within their networks. This practice is commonly referred to as “interest-based advertising,” “cross-context behavioral advertising,” or “personalized advertising.”

We may also disclose your personal information with third parties as appropriate and permitted by law. These include to comply with law enforcement or national security requests and legal process, such as a court order or subpoena; protect your, our, or others’ rights, property, or safety; enforce our policies or contracts; collect amounts owed to us; or assist with an investigation or prosecution of suspected or actual illegal activity.

If we are involved in a merger, acquisition, financing due diligence, reorganization, bankruptcy, receivership, purchase or sale of assets, or transition of service to another provider, your information may be sold or transferred as part of such a transaction, as permitted by law and/or contract.

5. How Long we Retain Your Personal Information

We will retain your personal information for as long as you use Gno.land, or other NewTendermint products or services, for as long as necessary to fulfil the purpose(s) for which it was collected, resolve disputes, establish legal defenses, conduct audits, pursue legitimate business purposes, enforce our agreements, and comply with applicable laws.

6. Security of Your Personal Information

We take steps to ensure that your information is treated securely and in accordance with this Privacy Policy. Unfortunately, no system is 100% secure, and we cannot ensure or warrant the security of any information you provide to us. To the fullest extent permitted by applicable law, we do not accept liability for unauthorized access, use, disclosure, or loss of personal information.

By providing personal information to us, you agree that we may communicate with you electronically regarding security, privacy, and administrative issues relating to your use of Gno.land. If we learn of a security system’s breach, we may attempt to notify you electronically by posting a notice on our website, by mail, or by sending an email to you.

7. California Residents

California residents may request information concerning the categories of personal information, if any, we share with third parties or affiliates for their direct marketing purposes. If you would like more information, please contact us as outlined below.

Some browsers offer a “Do Not Track” privacy preference. Generally, when a user turns on the Do Not Track Signal, their browser sends a message to websites requesting that the user not be tracked. Our websites currently do not respond to “Do Not Track” signals.

8. EU Residents

Consumers in the EU are entitled to certain rights. These include:

  • Access to and Portability of Your Personal Information, including: (i) confirming whether we are processing your personal information; (ii) obtaining access to or a copy of your personal information; and (iii) receiving an electronic copy of personal information that you have provided to us, or asking us to send that information to another company in a structured, commonly used, and machine readable format (also known as the “right of data portability”);

  • Request Correction of your personal information where it is inaccurate or incomplete. In some cases, we may provide self-service tools that enable you to update your personal information;

  • Request Deletion of your personal information;

  • Request Restriction of or Object to our processing of your personal information where the processing of your personal information is based on our legitimate interest or for direct marketing purposes, including opting out of profiling in furtherance of decisions that produce legal or similarly significant effects concerning you (please note that we do not currently engage in such profiling); and

  • Withdraw your Consent to our processing of your personal information. Please note that your withdrawal will only take effect for future processing and will not affect the lawfulness of processing before the withdrawal.

9. Supervisory Authority

If your personal information is subject to the applicable data protection laws of the European Economic Area, Switzerland, or the United Kingdom you have the right to lodge a complaint with the competent supervisory authority or attorney general if you believe our processing of your personal information violates applicable law.

10. International Data Transfers

All information processed by us may be transferred, processed, and stored anywhere in the world, including, but not limited to, the United States or other countries, which may have data protection laws that are different from the laws where you live. We endeavor to safeguard your information consistent with the requirements of applicable laws.

If we transfer personal information which originates in the European Economic Area, Switzerland, and/or the United Kingdom to a country that has not been found to provide an adequate level of protection under applicable data protection laws, one of the safeguards we may use to support such transfer is the EU Standard Contractual Clauses.
